1. Agreement to Terms

By purchasing, downloading, installing, or using QuickPCPro software ("Software"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Software. These Terms constitute a legally binding agreement between you and Digibay Private Limited ("Company," "we," "us," or "our").

2. License Grant

2.1 Scope of License

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Install and use the Software on up to three (3) personal computers
• Use the Software for personal, non-commercial purposes
• Receive updates and support as provided

2.2 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the Software
• Reverse engineer, decompile, or disassemble the Software
• Rent, lease, lend, sell, redistribute, or sublicense the Software
• Remove or alter any proprietary notices or labels
• Use the Software for commercial purposes without authorization
• Use the Software in any way that violates applicable laws

3. Payment and Fees

3.1 Pricing

The Software is available for a one-time payment of $34.95 USD. This grants you a lifetime license for up to 3 PCs. All prices are subject to change with notice.

3.2 Payment Processing

Payment processing is handled by third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the applicable fees.

3.3 Taxes

All fees are exclusive of applicable taxes. You are responsible for paying all taxes associated with your purchase.

4. Refund Policy

We offer a 30-day money-back guarantee. If you are not satisfied with the Software, you may request a full refund within 30 days of purchase. For complete refund terms, please see our Refund Policy.

5. Software Updates and Support

5.1 Updates

We may provide updates, patches, and new versions of the Software. Updates may be automatically downloaded and installed. You agree to receive such updates as part of your use of the Software.

5.2 Technical Support

We provide technical support via email at support@quickpcpro.com. Support availability and response times are not guaranteed but we strive to respond within 24-48 hours.

6. User Responsibilities

You agree to:

• Use the Software in compliance with all applicable laws and regulations
• Not use the Software to harm, threaten, or harass others
• Maintain the security and confidentiality of your license key
• Create regular backups of your data before using the Software
• Not attempt to circumvent any technical limitations or security measures

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the Software will be error-free, secure, or uninterrupted
• That defects will be corrected
• That the Software will meet your requirements

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DIGIBAY PRIVATE LIMITED BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or alteration of your data
• Damages resulting from the use or inability to use the Software

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE ($34.95 USD).

9. Indemnification

You agree to indemnify, defend, and hold harmless Digibay Private Limited and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Software or violation of these Terms.

10. Termination

We may terminate or suspend your license immediately, without prior notice, if you breach these Terms. Upon termination:

• Your right to use the Software will immediately cease
• You must delete all copies of the Software
• No refund will be provided for violations of these Terms

11. Intellectual Property

The Software, including all content, features, and functionality, is owned by Digibay Private Limited and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Navi Mumbai, India.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Software after changes constitutes acceptance of the modified Terms.
